Agreement

By choosing to use KoolCreations product(s), services you accept and agree to be bound by these terms and conditions.


Liability

KoolCreations liability these terms and conditions which have been set out are the full and complete extent of or obligations and liabilities in respect of product(s), services and support. We do not offer or provide warranties on any product(s) or services in any way unless stated.

Any warranty or condition including any term arising out of or in connection with the supply of product(s) or services which might otherwise be implied into or incorporated in the contract by statute, common law, laws applicable where you purchased the product(s) or services or otherwise which also includes without limitation any implied, Also nothing shall limit or exclude our liability such as;


A. Fraud
B. Any breach of obligations implied by applicable compulsory national laws as to title
C. For death or personal injury caused by our negligence
D. Any liability which cannot be excluded by law.

Also KoolCreations will not be liable in any way for loss or damage of any kind, loss of contracts, loss of data, loss of income, loss of profits, or any loss of any kind also for any indirect or consequential loss of damage of any kind which also includes negligence breach of contract or otherwise. KoolCreations maximum aggregate liability under contract which also includes negligence or otherwise shall in no circumstances exceed the amount payable by yourself to KoolCreations in respects of the product(s) or services in question.


Also KoolCreations will not be liable in any way for any type of failed inspection or any inspection of any type. Also including loss or damage of any kind, loss of contracts, loss of data, loss of income, loss of profits, or any loss of any kind also for any indirect or consequential loss of damage of any kind which also includes negligence breach of contract or otherwise.


CIRCUMSTANCES BEYOND OUR CONTROL
KoolCreations cannot be held responsible for failure to attend or deliver or delay due to any and all circumstances beyond our reasonable control. KoolCreations will make every effort to honour agreed dates and times. In the event of a delay we will perform our obligations as soon as reasonably possible.


Website Changes/Change to T&C

KoolCreations reserves the right to change our website and terms and conditions at any time.


KoolCreations Quality Control

Any and all projects are quality controlled by the team attending the project in question or by our head of projects (Daniel Searle) As each project is unique, each project will be assessed based on the state of the project before any work has been carried out, the project budget, the work and materials needed, and time scale. With these factors Koolcreations reserves the right to set the quality control pass mark.


KoolCreations Project Deposit/Deposits

Any and all deposits paid for our project slots, are non-refundable, under any circumstance.


KoolCreations Project Paint and Materials Payments

Any and all payments paid for paint and materials, once ordered are non-refundable, under any circumstance. All paint and materials will remain the property of Koolcreations.


KoolCreations Finale Project Payments

Finale project payment is to be made in two payments of 50% of the outstanding project amount - the first payment needs to be paid upon application of primer (first day onsite). The finale payment needs to be paid before the finale onsite day starts. If the onsite phase is over a one day period, finale payment needs to have cleared before the work starts. The payments needs to have cleared into the KoolCreations account, before the team leaves the site. This is non-negotiable under any circumstance/s. If payment cannot be made the project would need to rescheduled, when payment is possible.


KoolCreations Project Cancelations & Payments

If you the client cancels the project on, during or after the agreed project start date, KoolCreations will not refund any or all payments made for the project in question and you maybe charged for days wasted. If you the client cancels the project before the onsite phase begins but the doors/drawers have been prepared and sprayed. You the client will be required to pay for the work completed, including storage costs for the doors/drawers in question, plus a the cost to drop the doors/drawers back to you. To re-fit the door/drawers at this time will be an added charge also. Failing to pay within the updated payment schedule will incur a daily charge of £50.00. This will continue for ten days. If after this point payment has still not been made. We will pass the debt including any and all extra charges to the relevant debt collection agency, who will then contact you so to resolve.


KoolCreations Wasted project slots

If you the client causes Koolcreations to lose project slot/slots for any reason at all, any and all payments made by you the client will not be refunded and taken as compensation for project slots lost.


KoolCreations Failure to Make Payment/Payments

If you the client fails to make payment based on the project payment schedule we reserve the right to reschedule your project until the relevant payment has been made, we will also move forward your payment schedule before proceeding with the project, If the payment in question is the finale project payment, you the client will have 48 hours to make payment of any outstanding project cost amount. Failing to do so will incur a daily charge of £50.00. This will continue for ten days. If after this point payment has still not been made. We will pass the debt including any and all extra charges to the relevant debt collection agency, who will then contact you so to resolve.


(All payments need to have been paid and cleared into our account before the team leaves the site)


KoolCreations Project Kitchen Costs/Estimates

Any Project cost/estimate provided is for our standard preparation and spraying service. This includes doors, drawers, kick boards, end panels and cooker hoods (not under sections/air extractors) if agreed. The cost does not include carcasses, carcass front facing trims or anything else within the kitchen in question.


Our standard service does not include any damage currently on the units, nor does it include taking the units in question back to the original surface. Such services would come under a restoration service, which needs to be requested by you the client prior to a project cost confirmation


Project estimates does not include any or all damage, unless agreed by KoolCreations beforehand.


KoolCreations Project costs are based on information and pictures provided by you the client, it is the you the client responsibility to provide accurate information and pictures of all units that is to be prepared and sprayed. Any units not shown or mentioned within the information and pictures provided, will be charged accordingly. Please insure you highlight any damage you wish to have repaired during this stage.


Not providing all the information mentioned above may delay your project start date, and incur charges, if our technician needs to reschedule a visit.


KoolCreations project Days/Dates Missed Due to Clients Not Being On-site

If the Koolcreation technician/team attends the project site and is unable to complete an onsite project due to you the client not providing access to the site or not providing access upon arrival of the team (maximum wait time 20min, after this time the team will leave the site), or arranging adequate parking so the team can complete the project without issue, on the agreed or confirmed day/date. You the client will be charged £300.00 (each) for a two man team, or £400.00 for a one man team for both consecutive days due to the technician/team day being wasted. We will also charge fuel costs and charges for ULEZ. These cost would be added to the outstanding project cost. The total outstanding project cost would need to be paid in full, before the team attends the agreed rescheduled date.


The project will not be completed until this payment has been made.


KoolCreations project Days/Dates Missed Due to Clients Not Having Kitchen/Kitchen Space Ready

If the Koolcreation technician/team attends the project site and is unable to complete an onsite project due to you the client not having the kitchen prepared as agreed, cleaned and ready, or the space emptied on the agreed or confirmed day/date. You the client will be charged £300.00 (each) for a two man team, or £400.00 for a one man team for both consecutive days due to the technician/team day being wasted. We will also charge fuel costs and charges for ULEZ. These cost would be added to the outstanding project cost. The total outstanding project cost would need to be paid in full, before the team attends the agreed rescheduled date.


Kitchen must be free from excess dirt, grime, grease etc. For example grease build up near cookers/hobs can be running your hand over a nearby unit and feeling the grease also sticky to the touch. Please contact us for clarification.


Space around the kitchen units that are to be sprayed need to cleared of all furniture, sides need to be cleared of kettle, toaster etc, drawers need to be emptied. Please contact us for clarification.


The project will not be completed until this payment has been made.


KoolCreations Parking/Parking Penalties

Any and all parking charges are to be paid by you the client, the final parking total charged will be added to the final project cost, or confirmed upon completion of your project. This is to be paid before the onsite team leave the project site.


KoolCreations Parking Onsite (your property)

Any and all parking arrangements are to be arranged by you the client, Koolcreations cannot be expected to arrange permits, tickets or bay reservations of any kind. We operate by using 4x4. A parking bay needs to be within 100 feet of the site entrance and also cover an 8 hour undisrupted parking window. Parking bays with limited maximum time limits (under 8 hours) are not suitable.


KoolCreations Posting of project items/units

Koolcreations will use any postal service specified by you the client. If no service is specified we will opt for a tracked and traced service. All postal service are paid by you the client unless confirmed otherwise by Koolcreations.


Koolcreations does not except any responsibility for the item in question once the item is dropped to the relevant postal office or depo. Any or all issues that may arise in transit is down for you the client to resolve with the service provider in question.


KoolCreations Projects

Any project consisting of 10 doors or more is considered a open standard project, with this the preparation

and spraying process changes from a typical bespoke project.

There would be an allowance of 10-15% for dirt and debris. if still within the final colour coat these cannot be removed and will clear our project QC.


We cannot except responsibility if the doors are damaged in any way during the refit process, it is the clients responsibility to insure all door frames etc have been prepared for the newly painted doors.


We cannot except responsibility if once the doors/drawers have been sprayed these do not fit due to the extra paint applied.


The refit of door projects is a curtesy and would need to be confirmed, we reserve the right to reschedule

a refit at anytime.


KoolCreations door project costs do not include the removal the door hardware i.e. handles, locks etc.


KoolCreations does not except responsibility of any paint build up on the glass or rubber trim that needs masking on the doors in question. Such sections should be removed before KoolCreations starts the project in question.


KoolCreations Bookcases/Built-in Units Projects

Any bookcase/built-in unit projects full under the same terms as our kitchen projects.


KoolCreations Projects - Kitchen Projects with current substandard paint work.

Kitchen's with current substandard paint or paint reactions. If we choose to undertake any project with substandard paint work, for example chips, flaking paint work, current paint reactions etc. We cannot accept any responsibility if any or all issues that may arise once we have carried out our process. Its understood by you the client that this is a possibility and we will not be required to attend or carry out any extra work if such issues arise.


KoolCreations Projects - Kitchen/unit Projects with ongoing paint reactions/stains.

On occasion, projects may have panels that continually react or have stains come through after priming and top coat, if after 2-4 coats of our stain blocking primer does not resolve the issue, we would then need to touch in by hand during the re-fit phase.


KoolCreations Projects With MDF Sections

Any project consisting of MDF sections will need to be charged for depending on the section, as MDF requires extra preparation and materials, please insure who ever installs the unit in question has filled all holes and edges filed prior to us starting the project, as this would also need to be charged if we are required to carry out upon request.




KoolCreations cannot accept responsibility or liability in any way for the points listed below:


  1. Once a colour has been chosen and confirmed by yourself, KoolCreations will request a finale confirmation before your project begins via email or any communication method KoolCreations have used. We will send a picture of the colour in question for reference and for you to use so to confirm you are happy for us to complete your project with the colour in question. As soon as we receive confirmation you are happy for us to proceed. We cannot be expected to change once the chosen colour and finish has been applied to the agreed furniture/surface/project.
  2. KoolCreations uses the Renner paint system, all colours are colour matched within an acceptable tolerance (please note a 100% colour match is not possible) , It is your responsibility to highlight any issues you may have with the finale colour, KoolCreations takes no responsibility for any or all issues with the finale colour match once the project has begun or has been completed.
  3. Any colour changes made, once a colour has been agreed between you and KoolCreations, once ordered will be charged to the you.
  4. Any changes requested by you with regards to colour changes during the project, has to be agreed by KoolCreations, and will be charged to you to accordingly.
  5. If you the client chooses to cancel the project whilst the project is ongoing and the colour coat has been applied to the doors/drawers prior to you choosing to cancel the project. The colour applied will be signed off and not liable for re-work or any amends of any kind and the colour and colour match will be finale without any exceptions.
  6. KoolCreations only estimate for our standard colour change service unless an extra service or services are requested by you and agreed by Koolcreations.
  7. KoolCreations will not be liable nor replace or buy new any section/sections or as a whole and complete kitchen, any unit or item under any circumstances. It's understood that an element risk is always involved when preparing, spraying or changing a kitchen, any unit or item.
  8. KoolCreations will not be liable for any damage, brakes or any issues that may arise during the removal or refit of the doors/drawers or all sections of the kitchen in question. It's understood that kitchens which are older then 1 year could have current issues seen or unseen.
  9. KoolCreations does not accept responsibility for splits, cracks, chips, or any natural occurrence associated with any type of surface.
  10. KoolCreations does not accept responsibility for splits, cracks, chips, or any natural occurrence associated with any type of surface if highlighted once the spraying process has been completed, unless our restoration service or surface transformation have been chosen and agreed.
  11. KoolCreations does not accept responsibility if after the preparation and spraying process, stain bleed through occurs. Any project consisting of 10 doors or more is considered a open standard project, with this the preparation and spraying process changes from a typical bespoke project.

  14. KoolCreations Offer a pickup and drop off service, KoolCreations cannot be held responsible for any damage caused during the removal of furniture or any item during pickup or drop off.
  15. KoolCreations does not accept responsibility for any paint or wallpaper removed by the masking process, during the onsite phase of any project.
  16. KoolCreations does not accept responsibility for any or all paint issues that result from prior sub-standard sealer (any type of sealer) It is your responsibility to remove any sub-standard before the agreed project start date. If not removed the KoolCreations team will prepare and spray with the current sealer in place.
  17. KoolCreations does not remove built-in dishwasher/fridge covers, or any integrated units, nor do we remove kickboards, we do not spray trims/sections that sit behind the mentioned covers.
  18. KoolCreations projects costs do not include preparation and spraying interiors of built-in fridge/freezer doors, however the onsite team will endeavour to spray if possible to remove or if the kitchen manufacture removes the doors/doors for the team to spray, we do not spray under sections of cooker hoods (extraction points).
  19. The KoolCreation onsite team reserves the right to not spray any part of a kitchen, if unable to do so to a satisfactory standard.
  20. KoolCreations onsite team will always endeavour to spray every section agreed, however if the onsite team is unable to for any reason, the team will need to leave the section in question.
  21. KoolCreations may need to drill small holes in the unseen ends of doors/drawers (top or bottom ends), so to hang to be sprayed. If this is the case, we would not fill these holes once prepared and sprayed.
  22. KoolCreations may need to spray hinges when carrying out onsite projects, we would not replace nor clean the hinges in this situation.
  23. KoolCreations cannot guarantee that every section of the kitchen will be sprayed, as not all sections have a clear line of sight for the application of paint.
  24. KoolCreations project schedules are estimates only, we cannot be held responsible if a project overruns due to circumstances beyond our control, extra preparation needed to complete a project, or any unforeseen reasons.
  25. KoolCreations reserves the right to reschedule a project at anytime.
  26. KoolCreations reserves the right to secure and withhold doors/drawers if any project costs are unpaid. Upon payment the doors/drawers in question will be released.
  27. KoolCreations cannot be held responsible if doors or draws do not fit during the re-fit phase, if a kitchen is old, worn and degrading.
  28. KoolCreations will not remove hinges that are old, or present possible issues, these will be sprayed attached to the unit in question.
  29. KoolCreations onsite team can refuse to re-fit any door, draw or panel if they feel they may cause damage to the panel in question due to age or current damage the panel in question may have.
  30. Koolcreations normally spray larger doors onsite, this sometimes means that we would need to spray the hinges whilst the door is still attached.
  31. KoolCreations reserves the right to sign-off and pass any laminated doors that have undergone our hole filling and drilling service.
  32. KoolCreations hole filling and drilling service does not require KoooCreations to level up the back of doors/drawers when filling. Only the front facing area.
  33. If you the client chooses to fill holes or damage prior to the project start date, its you the client responsibility to insure a good finish. Koolcreations can only assume that you the client are happy with the current finish. Koolcreations can accept no responsibility for the filler you the client has applied nor the current finish. We will highlight any issues prior to priming of the units in question and offer you the client the opportunity to have these rectified by us. We charge £25.00 per unit. If you choose not to have the units rectified, we will proceed with the primer phase with the filler applied by you the client.

New Pre-Primed Kitchens

  1. Koolcreations will only take delivery and accept the agreed items to be sprayed, any extra items if required to be stored would be done so at cost, and only if agreed by Koolcreations.
  2. Koolcreations will prepare and spray the agreed items, only when you have confirmed that the items delivered are correct and are to be prepared and sprayed.
  3. Koolcreation excepts no responsibility for any or all issues that may arise from pre-primed kitchens, the kitchen doors, drawers, all panels etc. It's you the clients responsibility to insure the primer is of a good and correct standard for the standard preparation and spraying process.
  4. Koolcreation does not accept responsibility for any type of damage, imperfection or any issue of any type, with any of the units delivered to us. We will inform you of any of the prementioned issues during the unpacking and cataloguing phase of the project and will await confirmation on how you wish to proceed.

KoolCreations Commercial/Specialised & Cast Resin Projects

  1. KoolCreations may make use of one of our out of house teams when undertaking Commercial/Specialised & Cast Resin Projects.
  2. All work carried out by out of house team, will be the responsibility of the out of house team, during the project and after if needed
  3. KoolCreations reserves the right to halt a project if the agreed payment schedule is not paid on time.
