Terms & Conditions 

1. All prices quoted are exclusive of VAT 

  2. Prices are fixed for a period of 3 Months from the quotation date. 

  3. We recommend that flooring substrates consisting of sand/ cement screed (4Parts sand: 1 part cement) should always be prepared with a minimum of 50mm screed. Pumped screed should be primed each layer at least two layers at 2-5mm thickness. 

  4. Costs given are for continuous working during normal hours (Mon-Fri, 8am-5pm).

  5. Costs are subject to verification of a site re-measure where applicable. 

  6. Payment terms are: 50% on booking, 25% two weeks prior to commencement, 25% on competition. 

  7. Late payment may result the suspension of any additional works required. The customer is obliged to pay Koolcreations invoices on completion and or on receipt of the invoice. The customer will be charged late-payment fees in the event of late payment at a rate equivalent to 5% above the prevailing Bank of England Base Rate. The customer will be charged a minimum of £450 in the event of late payment and towards collection costs incurred by Koolcreations in collecting  outstanding Invoice payments. 

  8. Adequate water and electricity supply (240v/110v - 32 AMP) overhead lighting (i.e. not task lighting) and warm air (convection or radiation) heating should be available during work activities. Gas heaters are not suitable due to humidity levels generated. 

  9. It is essential that the heating is available before any installation to ensure that the ambient room temperature is 20 degrees Celsius. Under floor heating MUST be switched off a minimum of 24 hours prior to installation. Failure to ensure this may effect the installation process and koolcreations cannot accept any responsibility. 

  10. Our quotation includes for work as detailed only. Any changes or additions to the description hereto will be costed  accordingly and will be subject to the Terms and Conditions outlined herein. 

  11. Our quotation is based on cleared, cleaned areas only unless stated. Any delays due to the floor area being inaccessible will be charged at the hourly rate per man per hour, which is £50.00 per man per hour. 

  12. The client is responsible for re-routing of all cables, wires etc. That may run across the sub floor before installation of new floor covering. If this prevents an installation proceeding on a booked installation date, this could incur a                        cancellation charge or waiting time charge. Koolcreations accepts no responsibility for damage to wires or cables during installation. 

  13. All cementitious screeds require a damp Proof membrane (“DPM”) or damp proof course (“DPC”). In the event that there is no DPM or DPC, water May seep up and rupture the resin floor in the form of blisters. Koolcreations accepts no responsibility for such damage. The substrate floor should be allowed to dry. Substrate moisture levels should be no higher than 4% for concrete, 2.5% for sand and cement screeds - ref: concrete moisture test (“CM” test). For anhydrite           screeds should be no higher than 0.5% (CM test). 

   14. Sand cement levelling layers should be dry, well bonded and sufficiently strong (Fcu>25N/mm2). There should be no cracks, day joints, holes, fissures, honeycombing or imperfections. There shall be sufficient movement or control joints in the subfloor including expansion joints, contraction joints to accommodate the expected movement within the screed. This should be in accordance with BS8204

   15. All resin screeds and resin coatings are made and installed by using two component liquids (resins and hardeners) and  are applied to achieve as consistent a surface finish and view as possible. However, due to site conditions, variation in            pigments, and differing aggregate content variations in colour, texture and overall appearance can occur. These are beyond the Koolcreations and the suppliers control. Mechanical damage, moisture related blisterin, scratches discolouration, minor seem formation, crack or vein formation due to the effects of movement or subsidence in the substrate and/or any supporting structure, slight roller tracks and brushstrokes in the top coat and dirt embedded in surfaces are excluded from the guarantee. 

    16. Koolcreations reserves the right to use products of koolcrations choosing. 

    17. Please note: materials are applied manually and during the process minor marks, including roller marks, may occur. The self-levelling systems and materials are also applied manually. Hence, while every endeavour is made by Koolcreations to obtain the smoothest/ flattest surface possible minor undulations (1-3mm) may be present on completion. Koolcreations is not to be held responsible for post decorative work required. 

     18. When carrying out work activities, the customer should take the following points into account. Koolcreations surfaces will differ with respect to the samples shown to the customer during contract negotiations in the following respects: 1, slight colour differences. 2, Differences in sheen. 3, slight unevenness or visible application strokes. 4, Cracks in the substrate and/ or any movement in the underlying structure as a vein pattern reflected through the surface. 5, Dust specks or particles visible in the surface. 6, Due to handmade nature of the Koolcreations floors, the various colours are mixed and spread over the floor in situ. Continued mixing of colours while spreading the product over the              substrate. The method of application dictates that the floor’s appearance on site and will vary from project to project. This implies that differences in appearance across different areas of the same floor and between sections of the floor and rooms May arise. The result is an intrinsic element of a Koolcreation fusion floor. 7, Koolcreations surfaces are not resistant to abrasives, softening agents (Plasticisers) or colour concentrates, dyes. 

    19. In addition, it should be noted that coatings May show the profile of the substrate and/ or any underlying structure depending on how even/uneven it is. Koolcreations cannot be responsible for the condition of the substrate but is willing to counter any issues at an additional charge. 

    20. All floors are subject to movement. If the Substrate and/or underlying structure of the floor below moves, for whatever reason, and subsequently cracks can come through the top surfaces and are known as substrate cracking. These substrate cracks may be visible on the surface. Koolcreations cannot be responsible for substrate cracking. 

    21. After completion of installation and/or handover, at which point both parties have inspected the floor, agreed that it is in line with the work as stated in the contract and signed it off the koolcreations surfaces become the customer’s              responsibility. Without Prejudice to provisions in the law, the product only becomes the customer’s property once it has fulfilled all payment obligations arising from this legal relationship. All goods remain the property of Koolcreations until paid for in full. If there are any defects you must notify Koolcreations in writing within 72 hours after completion of the section of works to be able to benefit from the guarantee. Defects to be addressed in this way under the guarantee are     visible defects. Which could have and should have been detected without close investigation or microscopic scrutiny. Slight difference in size, form, shape, colour, structure, texture, pattern or other such observed defects do not constitute grounds for rejection.

    22. Please note: if we are working through a main contractor for a third party, these terms override all other considerations and maintains the goods as the property of koolcreations to incorporate this condition within its Terms and Conditions  with their client.

    23. Koolcreations reserves the right to levy a supercharge of £200.00 per man per day if the client changes an installation date within 10 working days of the agreed date or charge a cancellation/change in installation date fee of 25% of the total cost, which will be payable within fourteen days of the date change. Koolcreations cannot guarantee that they will be able to fulfil the clients change in installation date to the new date requested. The customer is obliged to pay Koolcreations invoices on completion and or on receipt of the invoice. The order is subject to written    confirmation.

     24. If your complaint is covered by the guarantee we shall repair the surface in question. When undertaking guarantee 

           work it is important that the customer makes available the floor free on obstacles and clean.

     25. On site, the main contractor/client will make provisions for safe and secured storage of the flooring products and at all times will be responsible for the health and safety of our operatives on their site. The customer will provide free of charge, skips and regulation compliant means of disposal for all general and packaging waste during installation. The            customer shall also cover all parking costs and/ or provide appropriate permits for the length of the contract.

      26. Except in the case of death or personal injury caused by our negligence, liability under or in connection with this or any other agreement between Koolcreations and the client whether arising in contract, tort, negligence, breach of statutory duty of otherwise, shall not exceed the sum of the replacement value of the work involved.

      27. Koolcreations shall not be held liable to the other in contract, tort, negligence, breach of statutory duty or otherwise of any loss, damage, costs or expenses of any nature whatsoever incurred or suffered by the other of an indirect or                 consequential nature including without limitation any economic loss or other loss of turnover profits, business, or goodwill.

      28. All prices quoted are subject to zero % retention unless previously agreed prior to commencement of work.

      29. Public liability insurance is provided by Koolcreations to their own operatives and take no responsibility for client

            employees/visitors/personnel on site that do not have the required insurance whilst the work is being undertaken in                the vicinity.

      30. Koolcreations cannot be held responsible for unforeseen failures in the substrate and/or underlying structure that are not obvious or clear on the outset of the work (e.g.: weak or non-concrete substrates found beneath existing floors). If, once revealed, Koolcreations will inform the site contact and proceed accordingly. In such circumstances there will              be additional costs that may involve reinforcements , additional prep, pump screeds etc. the original specification remains chargeable and if installed as per the quotation will be chargeable in addition to the extra work.

      31. Koolcreations warrants that goods supplied will be free from defects in workmanship for a maximum period of warranty for one year. The warranty shall be provided on completion of the work(s) and the clients approval and receipt of all payments by Koolcreations.

      32. All floor remedial work post completion, (see clause 20). Payment is strictly 10 working days in full prior to the commencement.

      33. Any water incursion onto the screed must be disclosed by the client to Koolcreations prior to Koolcreations carrying out any work on the project.

      34. Koolcreations guarantees the Installation by Koolcreations of all workmanship for a period of years from the date of completion. This guarantee Will be void upon any third party work, unless approved by Koolcreations, Koolcreations shall be under no liability in respect of any defect arising from excessive wear and tear, wilful damage, negligence,                mechanical damage, change of use, substrate failure, abnormal working conditions, failure to follow Koolcreations or the manufacture's written instructions, misuse or alteration or repair of the goods. The guarantee shall be provided on completion of the work(s) and the clients approval and receipt of all Payments by Koolcreations.

       35. This agreement shall be governed by, and construed in accordance with the law of England and Wales. Any dispute arising out of or in connection with, or concerning the carrying into effect of this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales, and the parties hereby submit to the exclusive jurisdiction of those courts for these purposes.
